There's a worryingly trend in recent years when it comes to new controllers suffering joystick drift. While most prominent on the Nintendo Switch, Microsoft recently faced renewed legal action by US law firm CSK&D over Xbox One Controller drift.
First filed back in April 2020, CSK&D alleged that numerous consumers had the same drift issues with their controllers, which registers movement without user input. That complaint was amended last October, addressing additional concerns about the Xbox Elite Series 1 and 2 controllers.
Xbox One Controller Drift Lawsuit Is Being Settled Out Of Court
Microsoft responded to this call back in February, looking to settle this outside of the courtroom by requesting an impartial adjudicator. Though CSK&D remained committed to recuperating damages, alleging the Xbox One controllers have had consistent flaws since 2014, Microsoft's request has now been approved.
Speaking to The Loadout, CSK&D partner Benjamin Johns called the case being compelled to arbitration as "the end of the road", as it'll likely avoid ending up in a public court. Despite this, the US law firm are still pressing ahead, confirming their intentions to recover damages for their clients.
Previously, CSK&D had raised a lawsuit against Nintendo over Switch Joy-Con drift, though this was also compelled to arbitration in March 2020. They're still managing a similar lawsuit against Sony for the PlayStation 5's DualSense controller, though it seems likely to find a similar fate.
